Action by plaintiff Lothar W. Graf against defendant Franz Gerber to recover damages arising out of an alleged assault and
battery committed by defendant against plaintiff. The action was tried to the court and a jury. On September 26, 1963, the jury returned a special verdict wherein it was found
that on July 9, 1962, defendant committed an assault and battery on plaintiff, and assessed the compensatory damages at $10,000
and the punitive damages at "nothing." Plaintiff moved for judgment upon the verdict. Defendant moved inter alia for a new
trial in the interest of Justice because the damages were excessive. The trial court by order dated November 23, 1963, and
filed November 29, 1963, set aside the verdict and granted a new trial in the interest of Justice because the $10,000 of compensatory
damages found by the jury was excessive and contrary to the evidence. Plaintiff has appealed from this order. Further facts
will be stated in the opinion.
